1. Purpose

These Terms of Use (the "Terms") govern access to and use of the marketing website testcenterapp.com (the "Website"), published by TestCenterApp SAS (see the Legal Notice).

The Website presents Test Center App, a software-as-a-service solution for motorcycle and car brands and dealerships to manage test drives and events. These Terms apply to the Website only. Use of the Test Center App online service is governed by separate contractual terms.

By accessing or using the Website, you accept these Terms without reservation. If you do not accept them, please do not use the Website.

2. Access to the Website

The Website is freely accessible to any user with internet access. All costs related to accessing the Website (hardware, software, internet connection) are borne by the user.

We strive to keep the Website available at all times but do not guarantee uninterrupted access. Access may be suspended, in particular for maintenance, updates, or reasons beyond our control, without notice or compensation.

You agree not to use the Website in any unlawful manner, nor to undermine its operation or security (e.g. intrusion attempts, introduction of malicious code, automated mass extraction of content).

3. Intellectual property

The Website and all of its content (including texts, images, graphics, logos, videos, icons, trademarks, software and layout) are the exclusive property of TestCenterApp SAS or of third parties that have authorized their use, and are protected by French and international intellectual property laws.

Any reproduction, representation, modification, distribution or exploitation of all or part of the Website or its content, by any means and on any medium, without the prior written consent of TestCenterApp SAS is prohibited and may constitute an infringement punishable under Articles L. 335-2 et seq. of the French Intellectual Property Code.

The information on the Website is provided for general information purposes only. Although we take care to keep it accurate and up to date, we do not guarantee that it is complete, accurate or current, and it does not constitute a contractual offer.

TestCenterApp SAS cannot be held liable for:

• any damage resulting from fraudulent intrusion by a third party or from the presence of viruses;
• any direct or indirect damage resulting from access to or use of the Website, or from reliance on the information it contains, to the extent permitted by applicable law.

The Website may contain links to third-party websites. TestCenterApp SAS has no control over these websites and is not responsible for their content, availability or privacy practices. Accessing them is at your own risk.

Personal data collected through the Website is processed in accordance with our Privacy Policy.

7. Changes to these Terms

TestCenterApp SAS may modify these Terms and the content of the Website at any time. The applicable version of the Terms is the one published on the Website at the time of your visit. We invite you to consult them regularly.

8. Language

The Website is available in several languages. These Terms are drafted in English, which is the reference language. In the event of any discrepancy between translated versions, the English version prevails, unless mandatory law provides otherwise.

9. Governing law and jurisdiction

These Terms are governed by French law.

In the event of a dispute relating to the interpretation or performance of these Terms, the parties will first seek an amicable solution. Failing that, the dispute will be submitted to the courts of Paris, subject to mandatory rules of jurisdiction, in particular those protecting consumers.
